Yes. Vaping is legal nationwide for adults 21 and over. The big things UK visitors need to know: federal age is 21 (not 18), states set their own rules on flavours, taxes and public use, and only FDA-authorised products are legally sold. California, Massachusetts, New York, New Jersey and Rhode Island all have strict state flavour bans.
The USA is the most complex country in this guide because vape rules operate at two levels. Federal law sets a minimum framework. Each of the 50 states (plus DC and territories) adds its own rules on top. Within states, cities and counties can add further restrictions. UK visitors need to think about both layers depending on where they are.
A trip from New York to Las Vegas to San Francisco crosses three completely different vape regimes. New York has strict flavour bans and indoor rules. Nevada is permissive. California has the strictest flavour rules in the country. Plan ahead.
The FDA has approved relatively few vape products through the PMTA process. The legal product range is narrower than the visible store shelves in some states. Most flavoured disposables and many small-brand products are not officially authorised, even where you can find them.
The 50 states operate on a spectrum from very strict to very permissive. Here are the key patterns UK visitors should know.
The default approach varies by state but most major cities follow the same broad logic as the UK: indoor public use banned, outdoor permitted with venue discretion.
Bringing your UK vape kit to the USA is permitted for personal use. Sensible quantities, no declarations beyond what you would normally do at customs.
You will see vape products everywhere in some US cities and almost nowhere in others. Where you can buy depends on state and city rules.
Dedicated vape shops
Common across the country. Best selection of devices and TPD-equivalent products. Show photo ID showing age 21+.
Convenience stores and gas stations
Stock pod kits and limited disposable range. Stricter age verification than UK newsagents.
Tobacconists
US tobacconists stock vape products alongside tobacco. Less common than UK equivalents.
Online retailers
Several major US online vape retailers. PACT Act compliance required. Age verification by photo ID. Some states ban online sales to consumers (Vermont).
FDA-authorised brands only
If you want to stay strictly legal, ask the shop which products have PMTA approval. Most major brands are listed on the FDA's authorised products list.
US vape prices vary significantly by state due to excise taxes. A 30ml bottle of e-liquid that costs $15 in Texas might cost $25 in Massachusetts due to the 75% wholesale tax.
Vaping is legal but complex
Federal age 21, FDA-regulated products. 50 different state regimes. Plan for state variation on flavours, taxes and public use.
Bring your own kit and supplies
UK refillable kits work fine. State flavour bans mean your favourite flavour may not be available locally. Bring sufficient supply for the trip.
21+ is strictly enforced
Federal Tobacco 21 law applies nationwide. Carry passport for age verification. UK visitors under 21 cannot buy vape products.
