Federal versus state: how it works

The USA is the most complex country in this guide because vape rules operate at two levels. Federal law sets a minimum framework. Each of the 50 states (plus DC and territories) adds its own rules on top. Within states, cities and counties can add further restrictions. UK visitors need to think about both layers depending on where they are.

A trip from New York to Las Vegas to San Francisco crosses three completely different vape regimes. New York has strict flavour bans and indoor rules. Nevada is permissive. California has the strictest flavour rules in the country. Plan ahead.

• Federal Tobacco 21 law: Since 20 December 2019, the legal age to purchase any tobacco or nicotine product, including vapes, is 21 nationwide. No exceptions, including for military.
• FDA regulation: The Food and Drug Administration regulates all electronic nicotine delivery systems (ENDS) under the Family Smoking Prevention and Tobacco Control Act.
• PMTA requirement: Premarket Tobacco Application required for all products. Products without approval face enforcement action.
• Federal “seize and destroy” (2026): The FY 2026 Agriculture Appropriations bill empowers customs to destroy unauthorised vape shipments at the border immediately.
• PACT Act: The Prevent All Cigarette Trafficking Act applies to vape products. All online vape shipments must follow strict labelling, age verification and tax reporting.

What products you can actually buy

The FDA has approved relatively few vape products through the PMTA process. The legal product range is narrower than the visible store shelves in some states. Most flavoured disposables and many small-brand products are not officially authorised, even where you can find them.

• FDA-authorised products: Mostly tobacco and menthol-flavoured products from major manufacturers.
• Unauthorised products on shelves: Many flavoured disposables (Elf Bar, Lost Mary, etc.) face enforcement action. Some states (like Tennessee and California) maintain product directories that only allow listed brands.
• State flavour bans: California, Massachusetts, New York, New Jersey and Rhode Island enforce broad state-level flavour bans, typically permitting only tobacco and menthol.
• Sale of unauthorised products: Retailers face FDA civil penalties exceeding $21,000 per violation.
• UK-bought refillable kits: Generally OK to bring for personal use. Tourists can use their own kit and e-liquid throughout the trip.

The 50 states operate on a spectrum from very strict to very permissive. Here are the key patterns UK visitors should know.

Where you can and cannot vape

The default approach varies by state but most major cities follow the same broad logic as the UK: indoor public use banned, outdoor permitted with venue discretion.

Personal import for UK tourists

Bringing your UK vape kit to the USA is permitted for personal use. Sensible quantities, no declarations beyond what you would normally do at customs.

• Hand luggage only: Lithium battery devices in carry-on, never checked bags. Federal Aviation Administration rule.
• E-liquid quantities: Standard 100ml carry-on liquid rules. Bottles must be in clear bag.
• Reasonable personal supply: A few weeks worth of e-liquid for a typical holiday is fine. Bulk amounts may raise commercial-import questions.
• Disposables: UK disposables are banned for sale in the UK from June 2025. You cannot buy them in the UK but if you have some, you can take them to the USA for personal use.
• Customs declaration: Vape products do not need a specific declaration but if asked, declare honestly.

Buying vapes in the USA

You will see vape products everywhere in some US cities and almost nowhere in others. Where you can buy depends on state and city rules.

1. Dedicated vape shops

   Common across the country. Best selection of devices and TPD-equivalent products. Show photo ID showing age 21+.

2. Convenience stores and gas stations

   Stock pod kits and limited disposable range. Stricter age verification than UK newsagents.

3. Tobacconists

   US tobacconists stock vape products alongside tobacco. Less common than UK equivalents.

4. Online retailers

   Several major US online vape retailers. PACT Act compliance required. Age verification by photo ID. Some states ban online sales to consumers (Vermont).

5. FDA-authorised brands only

   If you want to stay strictly legal, ask the shop which products have PMTA approval. Most major brands are listed on the FDA's authorised products list.

US vape prices vary significantly by state due to excise taxes. A 30ml bottle of e-liquid that costs $15 in Texas might cost $25 in Massachusetts due to the 75% wholesale tax.
