Yes, vaping is legal in Spain for adults over 18 but the rules are tightening fast. New 2026 legislation will treat vapes exactly like cigarettes, banning use on bar terraces, beaches, playgrounds and public transport shelters. Some areas have already implemented their own outdoor bans. Fines can reach €2,000.
Spain is an EU member state with vaping laws built on the EU Tobacco Products Directive (TPD). For UK visitors that means your TPD-compliant kit and e-liquid are automatically compliant with Spanish product rules. The difference is where you can use it.
The big story for UK vapers heading to Spain is the proposed Spanish anti-tobacco law that has been moving through parliament. The legislation places vaping under exactly the same rules as cigarette smoking. This is a significant departure from the UK approach and from France, where vaping has been kept separate from smoking even as smoking restrictions tighten.
If the legislation passes as drafted, Spain will have one of the strictest vaping environments in the EU. Vapes will be legally equated with cigarettes for public-place use, advertising and sales restrictions. This is the opposite direction to UK policy which still treats vaping as harm-reduction.

Spain is moving to ban single-use disposable vapes as part of the same legislative package. As of early 2026 disposables are still legal for sale in most of Spain but expected to be illegal during 2026 or 2027.
Even before the new law takes full effect, Spanish venues set their own rules. The summary below reflects current practice and what to expect once the new legislation is in force.
Fines for vaping in restricted areas in Spain are higher than equivalent UK fines and can escalate quickly if the new law is enforced strictly.
Spain has a developed vape retail sector but the structure is different from the UK. The vast majority of TPD-compliant e-liquid and pod kit purchases happen through dedicated vape shops or tobacconists rather than newsagents.
Estancos (Spanish tobacconists)
State-licensed tobacconists found in every Spanish town. They sell cigarettes and an increasing range of vape products. Reliable for basic 10ml bottles and pod kits.
Dedicated vape shops
Concentrated in Madrid, Barcelona, Seville, Valencia, Málaga, Bilbao and the major tourist resorts. Better selection and advice.
Supermarkets
Limited vape range, mostly pod kits and 10ml bottles. Less reliable for specific flavours.
Resort and tourist area shops
The Costa del Sol, Mallorca and Tenerife all have shops catering to British and northern European visitors. Range often includes UK brands.
Online Spanish retailers
Same TPD products as UK. Some offer English-language sites and shipping to Spanish addresses. Useful if you are staying in a self-catered villa for several weeks.
Spanish e-liquid prices are typically similar to UK pre-duty prices, sometimes slightly higher. Once the UK VPD starts in October 2026, Spain may become cheaper for some vapers. Worth comparing prices if you are stocking up for a long stay.
